Welcome to Tag Smart (“we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our website at www.tagsmart.co.za, as well as the purchase of any products offered through the website.
By accessing or using our website, browsing our pages, placing an order, or engaging with any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in full. If you do not agree to these Terms, please do not use our website or purchase any products from us.
These Terms are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act, 2008 (“CPA”), the Electronic Communications and Transactions Act, 2002 (“ECTA”), and the Protection of Personal Information Act, 2013 (“POPIA”).
2. About Tag Smart
Tag Smart is a South African online retailer specialising in GPS and smart tracking devices for personal, household, pet, and business use. We source quality-tested products and supply them directly to consumers across South Africa via our website.
3. Eligibility
To use our website and purchase products from Tag Smart, you must:
Be at least 18 years of age or have the consent of a parent or legal guardian.
Have the legal capacity to enter into a binding agreement under South African law.
Provide accurate, current, and complete information as required during the registration or checkout process.
4. Products and Pricing
4.1 Product Descriptions
We make every reasonable effort to ensure that product descriptions, images, specifications, and features displayed on our website are accurate and up to date. However, we do not warrant that all descriptions are error-free, complete, or current. Product images are for illustrative purposes and actual products may differ slightly in appearance.
4.2 Pricing
All prices displayed on our website are in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) at the prevailing rate, unless otherwise stated. We reserve the right to amend our pricing at any time without prior notice. The price applicable to your order will be the price displayed at the time of purchase.
4.3 Availability
All products are subject to availability. In the event that a product is out of stock after your order has been placed, we will notify you as soon as reasonably possible and offer you the option of a refund, a substitution, or a back-order.
5. Ordering and Payment
5.1 Placing an Order
When you place an order on our website, you are making an offer to purchase the selected products subject to these Terms. We reserve the right to accept or decline any order at our discretion. An order is only confirmed once we have sent you an order confirmation via email.
5.2 Payment Methods
We accept payment via the methods displayed on our website at checkout, which may include credit card, debit card, EFT (electronic funds transfer), and other approved payment gateways. All payment transactions are processed by secure third-party payment providers. Tag Smart does not store your full payment card details.
5.3 Payment Security
We utilise industry-standard encryption and secure payment gateways to protect your financial information. However, we cannot guarantee the absolute security of data transmitted over the internet and you use the payment functionality at your own risk.
6. Delivery
6.1 Delivery Areas
We deliver nationwide across South Africa. Delivery to areas outside of South Africa may be available upon request and will be subject to additional terms and costs.
6.2 Delivery Timeframes
Estimated delivery times are provided at checkout and depend on your location and the availability of the product. We aim to deliver within 3 to 5 business days for standard delivery within major metropolitan areas. Delivery to remote areas may take longer. Delivery timeframes are estimates only and not guaranteed.
6.3 Delivery Charges
Delivery fees, if applicable, will be clearly displayed during the checkout process before you finalise your order.
6.4 Risk and Ownership
Risk in the products passes to you upon delivery. Ownership of the products transfers to you upon receipt of full payment.
7. Returns, Refunds, and Exchanges
7.1 Cooling-Off Period
In accordance with Section 44 of the Electronic Communications and Transactions Act (ECTA), you have the right to cancel an order and return a product within seven (7) calendar days of receiving delivery, without reason and without penalty. The product must be unused, in its original packaging, and in the same condition as when received.
7.2 Defective Products
In accordance with the Consumer Protection Act (CPA), if you receive a product that is defective, unsafe, or not as described, you are entitled to return it within six (6) months of delivery for a repair, replacement, or refund at your election. Tag Smart will bear the cost of return shipping for confirmed defective products.
7.3 How to Initiate a Return
To initiate a return, please contact us at support@tagsmart.co.za with your order number, a description of the issue, and any supporting photographs where applicable. We will provide you with return instructions within two (2) business days.
7.4 Refund Processing
Refunds will be processed using the original payment method within seven (7) to fourteen (14) business days of receiving the returned product and confirming it meets the return conditions.
8. Warranties and Disclaimers
8.1 Product Warranty
Tag Smart products carry a standard manufacturer’s warranty as specified on the product listing. The duration and terms of the warranty vary by product and manufacturer. Warranty claims must be directed to support@tagsmart.co.za.
8.2 Website Disclaimer
Our website is provided on an “as is” and “as available” basis. While we endeavour to keep the website operational and error-free, we do not warrant that:

8.3 Tracking Accuracy Disclaimer
GPS and smart tracking technology relies on satellite signals, mobile network coverage, Bluetooth connectivity, and other external factors. Tag Smart does not guarantee the absolute accuracy, reliability, or availability of location data provided by any tracking device. Tracking performance may be affected by environmental conditions, device battery levels, network outages, and other circumstances beyond our control.
Tag Smart products are designed to assist with locating items, pets, or persons and are not a substitute for professional security, surveillance, or emergency services.
9. Limitation of Liability
To the maximum extent permitted by South African law:
Tag Smart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website, products, or services, including but not limited to loss of data, loss of profits, or business interruption.
Our total liability for any claim arising from or in connection with your purchase shall not exceed the total amount paid by you for the product(s) in question.
Tag Smart shall not be liable for any loss, damage, or harm resulting from the failure or inaccuracy of any tracking device, including but not limited to loss of tracked items, pets, or persons.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under South African law, including under the Consumer Protection Act.
10. Intellectual Property
All content on the Tag Smart website, including but not limited to text, graphics, logos, images, product descriptions, website design, and software, is the property of Tag Smart or its licensors and is protected by South African and international intellectual property laws.
You may not reproduce, distribute, modify, display, create derivative works from, or otherwise use any content from our website without our prior written consent.
The Tag Smart name, logo, and the tagline “Tag it. Track it. Find it.” are trademarks of Tag Smart. Unauthorised use of these marks is strictly prohibited.
11. Acceptable Use
When using our website, you agree not to:

You agree to indemnify and hold Tag Smart, its directors, employees, agents, and partners harmless from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to your breach of these Terms, your misuse of the website, or your violation of any applicable law or the rights of any third party.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
Before initiating any legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation and, if necessary, mediation.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tag Smart in relation to your use of the website and the purchase of products. These Terms supersede any prior agreements, communications, or representations, whether oral or written.
